JHIUS may be deemed to be the beneficial owner of 3,382,836 shares, inclusive of certain pre funded andor common warrants (the Warrants). The Warrants are only exercisable within 60 days to the extent that, after giving effect to such exercise, the holders thereof and their affiliated persons would not beneficially own more than 9.99% of the outstanding common stock. Due to current common stock ownership levels, an additional 3,283,108 pre funded and 1,642,586 common warrants are therefore not reflected in the figures reported herein.
