Item 8.01 Other Events.

On August 23, 2023, Align Technology, Inc. (“Align”) issued a press release announcing that on August 21, 2023, the Superior Court, State of California, County of Santa Clara issued an order granting Align’s petition to confirm and denying SmileDirectClub LLC petition to vacate a $63 million arbitration award entered in favor of Align. A copy of the press release is attached hereto as Exhibit 99.1 and is incorporated herein by reference.
